These Terms of Service (“Terms”) govern your use of our website https://goodk9academy.com (the “Site”), any related services (collectively, the “Services”), and any communications or interactions with us. By accessing or using our Site or Services, you agree to be bound by these Terms. If you do not agree with these Terms, you must not use our Site or Services.

1. Eligibility

By using this website and our services, you agree that:

Our Services are operated from Gaithersburg, Maryland, in the United States. If you access or use our Site outside the U.S., you do so at your own risk and are responsible for compliance with local laws.

2. Services Overview

2.1 Dog Training Services

We provide dog training services including in-home dog training, board and train, group classes, puppy training, and behavioral modification programs. Any specific outcomes mentioned on our Site or in promotional materials are provided for illustrative purposes only. Individual results may vary, and you acknowledge that dog training depends on various factors, including the dog’s temperament, health, environment, and your participation.

2.2 No Veterinary Advice

Our Services are not intended to replace veterinary advice. For health or medical concerns regarding your pet, always consult a qualified veterinarian.

3. Dog Requirements & Owner Responsibilities

3.1 Owner/Guardian

You represent that you are the owner and/or authorized guardian of your dog and are fully authorized to enter this agreement.

3.2 Dog Requirements

You represent that your dog meets all of the following requirements:

• Is current on all required vaccinations
• Has been in good health for the last 30 days prior to training
• Has a completed Dog Profile on file
• Will enter and exit the facility on a leash

3.3 Health Disclosure

You represent that your dog has not had any contagious illnesses for 30 days prior to training. You understand that our employees are not veterinarians and cannot diagnose or detect illnesses. You agree to assume all risk associated with any activities during your dog’s training sessions. Vaccines do not protect against all contagious illnesses.

3.4 Duty to Disclose

You agree to disclose and continue to disclose any and all medical conditions, personality concerns, or behaviors that may affect, limit, or prevent your dog’s ability to participate in our services.

3.5 Accurate Information

You agree to provide accurate, current, and complete information as prompted by our booking forms or any other forms on our Site.

3.6 Compliance with Laws

You agree to comply with all applicable laws and regulations when using our Site and Services.

3.7 Prohibited Conduct

You must not:

• Use the Site or Services in any manner that could disrupt, interfere with, or adversely affect other users
• Upload or transmit any harmful code (viruses, malware, etc.)
• Harass, bully, or defame any individual or entity
• Attempt to gain unauthorized access to our systems or data

4. Health, Safety & Liability

4.1 Veterinary Care

You authorize Good K9 Academy to obtain veterinary medical treatment for your dog if, in our sole discretion, the dog appears ill, injured, or exhibits behavior suggesting medical treatment is needed. This may require transportation. You grant us full authority to make medical decisions during your dog’s training and agree to be fully responsible for all associated costs.

4.2 Assumption of Risk

You agree that you are assuming all risk of illness, disease, harm, or injury to your dog by allowing participation in activities at our facility. If your dog is injured by another dog, you release Good K9 Academy, its owners, employees, and agents from all liability. If your dog bites a human or another dog, we may contact the appropriate authorities.

4.3 Training Activities

Good K9 Academy utilizes various training methods and environments. Dogs may interact with other dogs during group sessions. While we provide reasonable care and supervision, minor incidents such as nicks and scratches may occur and may not always be noticed before departure.

5. Booking, Payments & Cancellations

5.1 Reservations

Confirmed reservations are required for training sessions. Scheduling and availability are subject to our current capacity.

5.2 Payment Terms

All fees are in U.S. dollars unless otherwise specified. You agree to pay all charges and fees incurred in connection with your bookings. Payment terms will be outlined in your service agreement.

5.3 Cancellations & Rescheduling

Any late, missed, or rescheduled training appointment may result in a fee. Trainers are compensated for their time.

5.4 Refunds

Any refund or cancellation policies will be stated on our Site or in your service agreement. We reserve the right to issue refunds at our sole discretion, in accordance with applicable law.

6. Photo & Video Release

You agree to allow us to use your dog’s name and any images or videos taken during training sessions, in any form or format, for use in any media, marketing, advertising, or promotional materials.

7. Intellectual Property

7.1 Our Content

All content on our Site, such as text, graphics, logos, images, videos, and software, is owned or licensed by Good K9 Academy and is protected by intellectual property laws. You may not reproduce, redistribute, or create derivative works from our content without our explicit written permission.

7.2 User-Generated Content

If our Site allows for user-generated content (e.g., testimonials, reviews), you grant us a non-exclusive, worldwide, royalty-free license to use, display, and distribute such content in connection with our Services.

8. Disclaimers

Our Site may contain links to third-party websites or services. We are not responsible for the content, accuracy, or practices of these third-party sites. Your use of such sites is at your own risk.

9. Limitation of Liability

11. Refusal & Termination of Service

Good K9 Academy reserves the right to deny admittance to any dog for any reason, at any time. We reserve the right to terminate or suspend your access to our Site or Services at any time, without prior notice, for any reason, including breach of these Terms.

12. Governing Law

These Terms shall be governed by the laws of the State of Maryland. Any legal action arising out of these Terms shall be instituted exclusively in the state or federal courts located in Montgomery County, Maryland.

13. Modifications

We may update these Terms from time to time. If we make significant changes, we will provide notice by posting a prominent notice on our Site. Your continued use of our Site or Services after any changes indicates your acceptance of the revised Terms.

14. Miscellaneous

• Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and Good K9 Academy regarding your use of our Site and Services.
• Severability: If any provision of these Terms is found unlawful, void, or unenforceable, that provision shall be deemed severable and shall not affect any remaining provisions.
• No Waiver: The failure to enforce any right or provision shall not constitute a waiver of such right or provision.

15. SMS/Text Messaging Terms

Good K9 Academy offers SMS/text messaging to provide booking confirmations, appointment reminders, promotional offers, and updates related to our dog training services.

You can cancel the SMS service at any time. Just text “STOP” to (301) 461-8042. After you send the SMS message “STOP” to us, we will send you an SMS message to confirm that you have been unsubscribed. After this, you will no longer receive SMS messages from us. If you want to join again, just sign up as you did the first time and we will start sending SMS messages to you again.

Carriers are not liable for delayed or undelivered messages.

As always, message and data rates may apply for any messages sent to you from us and to us from you. You will receive recurring messages. Message frequency varies. If you have any questions about your text plan or data plan, it is best to contact your wireless provider.
